The Florida Family Law Rules of Procedure
In Florida there are a number of sets of Rules grouped by subject and identified by the first digit
of the particular rule number. For example, the Florida Rules of Civil Procedure are classified in
the set assigned number 1 and are numbered as 1.xyz, like 1.140. The Florida Family Law
Rules of Procedure have been assigned number 12 and are numbered as 12.xyz, like 12.285.
Again, this component of the Florida Divorce Laws provides guidance and instruction regarding
issues that are not fully addressed in the Florida Divorce Statutes.
For example, the Florida child support statute shows how to calculate child support. However,
the statute is limited in its language regarding the service of the documents that are often used to
calculate the child support. So, the Rules supplement the Statute and specifically indicate when
financial affidavits and other documents need to be provided to the other parent depending on
what the parent is requesting and at what point in the proceedings it is being requested.
